DMCA Policy

Effective Date: February 7, 2025

Circlio respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). This policy explains how to report copyright infringement and our procedures for responding to valid notices.

1. Reporting Copyright Infringement

If you believe that content on Circlio infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be effective, your notice must include the elements described below.

Upon receipt of a valid takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing material and notify the user who posted the content.

2. DMCA Takedown Notice Requirements

Your takedown notice must be in writing and include all of the following:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
  2. Identification of the infringing material: A description of the material you claim is infringing, including the specific URL(s) or other information sufficient for us to locate the material on the Service.
  3. Your contact information: Your name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Signature: Your physical or electronic signature (or the signature of the person authorized to act on behalf of the copyright owner).

3. Counter-Notification

If your content was removed due to a DMCA takedown notice and you believe the removal was a mistake or that you have the right to use the material, you may submit a counter-notification. Your counter-notification must include:

  1. Identification of the removed material: A description of the material that was removed and its location before removal.
  2. Good faith statement: A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Delaware, if you are outside the United States), and that you will accept service of process from the person who filed the original takedown notice.
  4. Your contact information: Your name, address, telephone number, and email address.
  5. Signature: Your physical or electronic signature.

After We Receive a Counter-Notification

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within ten (10) to fourteen (14) business days that they have filed a court action to restrain the allegedly infringing activity, we will restore the removed material.

4. Repeat Infringer Policy

In accordance with the DMCA, Circlio maintains a policy of terminating the accounts of users who are repeat infringers in appropriate circumstances. Specifically:

  • First offense: The infringing content will be removed and the user will receive a warning notification
  • Second offense: The infringing content will be removed and the user will receive a final warning with notification that further violations will result in account termination
  • Third offense: The user's account will be permanently terminated

We reserve the right to terminate accounts after fewer offenses in cases of egregious or willful infringement. Counter-notifications that result in content restoration will not count as offenses.

5. Good Faith and Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.

Before submitting a DMCA takedown notice, please consider whether the use of the material may constitute fair use. If you are unsure whether the content infringes your rights, we recommend consulting an attorney.
